POLISH INTERNMENT

Global War game I am playing with tfclarinet
I am playing Allies and the Polish HQ and INF DIV were set up in Eastern Poland. When USSR exercised the occupation of Eastern Poland these 2 units entered Internment Pool.
During May/June 1940 USSR DOW Germany & Italy and the turn ended.
During Production Phase CW requested Polish units to be added to Forcepool (not intending to build at this stage).
Through to Allied Reinforcement Phase and these 2 units are still showing as in the Internment Pool
19.5.1 Rule regarding Eastern Poland only states that Interned Units can be added after USSR & Germany are at War, not specifying who did the DOW.
The rule explicitly states the polish MECH and MOT are not available until 1941, but nothing about other units.
Should these units be available to CW?

RAW:
Any Allied (except Soviet) units there are destroyed. They are removed from the
game (internment) until Germany and the USSR are at war, at which
point they may be added to the Commonwealth force pool if the
Commonwealth player so desires.
So in your example, the Polish HQ and the division are now in the "internment pool". The moment Germany and the USSR are at war, the CW gets a "special action" during the DoW phase at which time the CW player can decide to put those units into the CW force pool. Only after taking that "special action", the CW player can build those units.

The difference would consist that you wouldnt ned to add all the polish pool (which usually is lower quality) to get these ones, due to the fact that they were interned, wouldnt it?

Not really. This is the only way to get them. Adding the Polish force pool to the CW does no good unless Poland is unconquered. But if it is conquered, it is completely conquered, so all Polish units are removed from the game and future additions cannot be built.
Below is a special exception:
Anytime after 1941, the Commonwealth can add a randomly chosen Polish MOT and MECH to its force pools if, at that time:
ï The USSR has exercised its rights under the pact; and
ï Poland has been conquered by the Axis; and
ï The USSR and Germany are at war.

I understand I am no expert in these political rules, but I understand this differently. Shouldnt the text in red apply here?
19.5.1 Eastern Poland
The USSR can exercise its Nazi-Soviet Pact rights to occupy eastern Poland during any Allied land movement step. However, it can only exercise those rights if Poland has not been conquered.
You exercise those rights by moving a land unit into any hex of eastern Poland (ignore any units there). Once you exercise those rights, the part of Poland to the east of the partition line becomes conquered by the Soviets.
Move any Axis units there to the nearest Axis controlled hex they can stack in. Any Allied (except Soviet) units there are destroyed. They are removed from the game (internment) until Germany and the USSR are at war, at which point they may be added to the Commonwealth force pool if the Commonwealth player so desires.
Axis units may not cross the partition line after the USSR exercises its rights unless Germany and the USSR are at war.
Anytime after 1941, the Commonwealth can add a randomly chosen Polish MOT and MECH to its force pools if, at that time:
The USSR has exercised its rights under the pact; and
Poland has been conquered by the Axis; and
The USSR and Germany are at war.
All the Polish units covered by this rule are treated as British for all purposes.
However, I thought this affected all POL units, not only those in that area.
So this could be done before Poland is conquered by GE, after the GE DOW on USSR?

No it is a special rule for the N-Z Pact and has nothing to do with the normal rules of conquest which are in section 13. So any Polish units east of the partition line when Russia enters Poland are interned and cannot be brought out of internment until those conditions described are met. Polish units still on the map when Poland is conquered afterwards, are simply removed from the game as per the rules for complete conquest. That includes any units the CW added to their force pool when Poland aligned with them (and I have not seen that ever done).
The HQ and Inf Div are valuable additions and that is a ploy I have used on occasion.
The units the CW can add separately represent the Polish units that were formed from interned troops and joined the British 8th Army after the German attack on Russia, and fought in North Africa, Italy and France. This is a way of increasing their number at the risk of Poland being conquered sooner.
BTW it was recently clarified on BGG that even if Poland gets liberated, all these units we are discussing stay CW.
