At least I think it's new; the situation is a little unusual, so perhaps it hasn't come up before.

Fr is at war with Au and besieging Munich (Bavaria is Au conq). Here's the unusual circumstance: Pr, not a party to the war, sends a corps to northern Bavaria (this is allowed, as Pr is allied to Au and has access). This shouldn't have any effect, but:

Au goes unstable, loses Bavaria--to Prussia. (?!)

Fr corps still sitting at Munich, in (now) Pr territory....at least it's allowed to move, but only OUT.

Hmmmm???? That would be a new one and I suspect this has been around for a while since this does sound like a slightly unique situation??? Tell me though, what should happen to Bav in this scenario? Neutral? OR could the ally present (Pr) prevent the loss of the minor?

I think Bav goes to the nation with corps in the minor with the highest political status (i.e. defects to the biggest kid on the block that has an army present).

I don't think the presence of the Prussian corps should make any difference at all, since Prussia was not at war with anyone.

When Au enters instability, it loses Bavaria unless it has its own corps present (which it didn't in this case). If there are no enemy corps present, then Bav goes neutral. If, as here, a French corps is present, it should go French. But there's no circumstance under which it should go Prussian.

BUT the Pr ally throws a kink into the situation??? It would seem to me that an ally with access could possibly prevent a minor from leaving its ally due to instability, no?

Per EiA, if more than one *enemy* has corps present, control is resolved through competitive die rolls. (Political status is a modifier, but no the sole factor.) But in no case does control go to an ally.

If that were the case, then Bav should remain Austrian, not turn Prussian. But I don't see anything like that in the original EiA rules anyway, so I think it would be a deviation. Especially if (as here) the ally isn't even a combatant!

Here are the relevant rules, which don't say anything about allies:

10.5.2.1 BEING IN THE INSTABILITY ZONE: If a major power commences the Minor Country Control Step of a Political Phase in the Instability Zone of the display, all of the conquered minor countries of that major power become neutral, unless there is an unbesieged corps of that major power in the minor country.

10.5.2.3 CHANGING CONTROL: If an enemy corps is located in the minor country and/or an enemy garrison is in the minor country at these times, the minor country does not become neutral but is transferred to the control of that enemy major power instead (resolve control by competitive die rolls -as in 8.7.4 if two or more different enemy major power forces occupy the minor country). Free states whose control is transferred become conquered minor countries. When a minor free state becomes neutral or its control changes, all of its forces are removed, but a note is kept of its current fleet strength (which will become available if the minor country later again becomes a free state).

I agree with Ndrose: Bavaria should become French.

The only time a dispute should arise (inside the game) is if TWO warring powers have corps. In that case, it should be rolled randomly (with the same modifiers added as would be if this were a "major just declared war on a minor" contol selection).
