Possible bug

Anyone else had this? The unit was moving into enemy territory, was intercepted by enemy air units and thus set into "retreated" mode and suddenly it can now board train. What is going on?
I've seen something similar under patch 3.4 where a retreated unit with 1 MP left was able to embark on a seatransport. This was reported to Ralph a while back.
