Just noticed that at the bottom of the TOC screen I can view the enemy TOC, this is at the start and during the game.

I'm using 2.08 (steam version), I have enemy units and markers are always visible - would this enable the enemy TOC to be visible

Yes, if you can see the enemy units then FOW is off and the enemy TOC is visible.
