How to freely DoW Japan as Russia

This just happened to me in a PBEM. My opponent declared war on Mongolia as Russia, Mongolia joins the Axis and suddenly Japan is at war with Russia without any mobilization penalty for the US. I think that is an oversight and should be fixed.
