Question for the rules experts: Can a non hostile Vichy provide access to oil

Italy is aligned with Spain. Vichy is not hostile nor has DOW been declared on them. The Italian fighter and Franco show up as being able to use Italian oil to reorg.
How is this possible?
The Vichy CP in West Med cannot be the path otherwise the Italians would be in supply.
If a land route has been established it must trace a path thru a neutral country, Vichy.
