How do you get recon points on a minor regime?

In order to play a Stratagem "Offer Protection" to a minor regime you need to have at least minimum 1 recon point on that regime.
Is using spies the only way to do this? since you cannot move units into their territory without declaring war or is there another way as well?

My guess you're confusing Minor regime with Major regime.
You can (and usually should) move units into territory of MINOR regime - you're only unable to attack their units without declaring war. You're UNABLE to move into territory of MAJOR regimes.
For major regimes - if you're share a common border with them you will get level 1 recon on next turn. Don't remember if that work for minor regimes as I'm usually using spies to pick right targets (not a good idea to advance into slavers lands without preparation).

Your units can move into the territory of minor regimes without declaring war if you don't have a peace treaty with them yet. In order to have a peace treaty, you should've had diplomatic contact with them and should have 1 recon on them already because of that. Otherwise, you can advance into their territory and get the 1 recon by finding one of their units or assets.

Major Regimes respect Major Regime borders by default.
Minor Regimes and Majors only do that to each other after a peace deal.
If you send enough spies into a zone, you should get 1 Recon on all neighbouring zones. It is something I do anyway, to get some data on minor faction movements. Minors have a abysmal spy defense.

I thought peace treaty was only available to play when you are at war with a regime? are you referring to Open Contact when talking about diplomatic contact? i believe that is only for Major regimes unless there is a diplomatic contact stratagem i haven't seen in the game yet?

You don't engage into complex diplomacy with minors. All you can have with them : war, unsure (basic), peace, protectorate, vassal.
So "Peace treaty" for MINOR (!) is what you want. "Open contact" is for majors (obviously as it inside block labeled "Majors").

In order to get Contact you need to send a spy, also I think if you have contact with a unit of the Minor and can see it you may have contact, just entering his territory will not work.

The state you start with vs all minors is hard to define. I would say it about equals the "Cold War" mechanic from Endless Space 2:
- you can take some hostile action (taking each others terrain)
- but not the most important hostile actions (attacking units or cities), without declaring proper war first
