HQ supply stretching into non-cooperative territory

Recently I noticed the following situation:
A Turkish HQ in Galaty (Romania), with supply 5(8).
A Turkish Army one or two hexes north, which would have been in supply 6 or 7 from the HQ (no terrain penalty). However, the Army was beyond the Russian frontier (after Russian conquest of Bessarabia).
The territory was not in any meaningful sense Russian, as there were German units at Odessa, Uman etc as a salient between the russians in Eastern Ukraine and the Western Allies in Romania.
The Army was at strength 7 and unable to reinforce. I'm guessing because the unit was in uncooperative territory and so had a supply limit of some kind.
Two issues arise:
1) Shouldn't HQ supply extend over 'non-cooperative' territory?
2) If territory that 'belongs' to a major is non connected to that major, but is occupied by a different major on the same side, shouldn't 'non-cooperative' penalties be removed?
