Unlike the other games in the series ambush attacks when you run into a unit in ACW seem to have even outcomes. Such as both losing 2 points at the same time. Is this on purpose to be more even than other the other games in the series? My PBEM player and I were wondering this?

In the early game, yes even battles will happen. A brigade getting ambushed by another brigade is more a case of two forces blundering into each other and having a battle than it is a true "ambush", as neither force was especially well trained at that point in the war. Late game, ambushes are absolutely lethal. A corps can be destroyed wholesale if ambushed by another corps.
The longer the war went on, the armies became more sophisticated, and mistakes became more costly.

Thanks for all the info.
Does it mean that the rules of ambush change over the period of the game? Thanks

No ambush rules don't change. Its just that giving a readiness bonus to a corps with level 2-4 infantry equipment is a lot scarier than giving a readiness bonus to a brigade with 0 infantry equipment.
