I'm not sure if this is a bug or intentional.

I had a 5500 Infantry group attacking a hex (surrounded), and just to see how the odds would change - I added the OHQ unit, and then removed it before hitting 'attack'. First round, the infantry commander died even though his unit was not included in battle.

Did he die because he was still commanding the overall unit? or should he have been spared as his OHQ subunit was not involved?

Intentional. This can happen, especially if the leader has the Lead From the Front trait. The OHQ does not have to be present, though that seems to increase the probability.
