Germans in USSR while not at war

SU & Rumania are fighting after a refused bessarabia claim, but GE has not yet DOW'ed SU. Then Rumania takes some hexes inside SU. Can German units legally enter those hexes inside USSR?

I believe the answer is yes, the Germans can.
You cannot enter a hex controlled by:
A major power or minor country you’re not yet at war with on the other side.
Those hexes are not controlled by a major power you are not yet at war with.
