Mercenaries

I've set up a mercenary unit using the TOE system but every time I make a new unit nothing happens. Is it a bug?

Do you have any mercenaries? It's hard to tell without any real details...

Yes, I started new random phoenix game with hidden crates & got a mercenary factory giving me 40 mercenary a turn.

Maybe mercenaries are another people type than your own? Have you checked that? Because if you set a TO&E to have a different people than the ones you have, they will not send them out to the unit.
