Looking at that picture anyone could say CNI-FAI militias are better than Legionarios......

Yes, the stats are correct. You are probably misinterpreting what the anti-soft values mean. They just show the [unmodified] firepower against soft targets and not the quality of squads.

If you look at the load cost and the cargo capacity, you will see that the militia numbers are larger and thus have more men. In some cases, the members of the devices are women. So anyway, a direct comparison of of the squads is not accurate, you really need to the the firepower per man to have a better picture of the capabilities of the squads as well as how much punishment the squads can absorb before they are disabled or destroyed.
Then you also can look at upgrades for the devices and see that some upgrades are not a direct 1:1 upgrade. Some may give more devices while others may give fewer devices when upgraded. The best part for those, is that you don't need numbers of the new devices in the pools, rather it is a reorganization and possibly reequipping of the existing manpower for some of the devices.

But then, with all that in mind. Whats the best way to compare squads? where should i check to see if i want to upgrade this squad type to this other squad type?.

Squad upgrade paths follow the historical changes of the composition of land units. At least as far as possible within the requirements of the game. Generally it will be more important to have enough squads of a given type available (in the pool or in reserve units) than to have always the best squads. In other words: Better to have complete combat units than to have understrength combat units.
But the differences in anti-soft values of individual squad types don't matter much anyway. Better to look at unit TOE to determine what is missing (mortars, machine gun squads, infantry squads etc.) and which changes a TOE upgrade will bring to the composition of a unit.

You look in the database in the game, it will let you know the hard and soft attack values and what the device upgrades to at the end.
