Dateline: London, British Foreign Ministry: In a what many have called a "Frank, Diplomatic Exchange", the British Foreign Minister sent the following communiqué to Japan's Foreign Ministry through the auspices of the Swiss Charge-d' affairs: "The British Commonwealth would like to take this opportunity to remind the Japanese Government that the current Japanese Army's Spring Offensive in East China must see to it hat the safety and integrity of Commonwealth property, financial assets, and personnel in the Greater Shanghai area must be respected and protected per International Norms for non-belligerent nations. Any deviation from these expectations could have the most serious and unfortunate results in terms of the relations between Japan and the Commonwealth. Britain has had a long history of trade relations with all nations in the region, and Britain is interested in maintaining this position regardless of the eventual outcome of the current hostilities in the Region.

The British communiqué appears verbatim in Japanese newspapers the following day. The Japanese Foreign Minister responds as follows:

“We would like to thank the British Foreign Ministry for bringing their concerns to our attention, and in the interest of harmonious relations we would like to share them, as well as our concerns with the world regarding the current situation in East China:

“On January 24, 1928, Japanese forces safeguarding commerce along the Yangtze River were attacked by Chinese forces. These forces included regular army units from the Republic of China, as well as United States soldiers from the 15th Infantry Regiment. This violated an unofficial ceasefire which had been observed by both sides which had brought peace to the area for over a year and a half. The Kwangtung Army fought valiantly, but was forced to cede about 180 miles to the invaders before halting the advance at an important rail junction.

“The Kwangtung Army has, and will continue to react as any disciplined military service when attacked. The aggressors and terrorists will be neutralized. Astute observers will note that our response will be very similar to the historic responses of the British Army when attacked in foreign lands such as Ireland and India. As most of our General Staff was educated in Great Britain, it is only natural that we will be using the British Army’s precedent as the standard norm for dealing with this crisis. So no nation should take issue with our actions, unless they have issues with those of the British Army.


“Regarding Shanghai – Japan continues to respect its neutrality, even though we seem to be the only combatant in this war which is doing so. Shanghai continues to be used as a base of offensive operations against Japan. American submarines are being repaired, replenished, and rearmed with both torpedoes and mines in Shanghai’s shipyards. Thousands of Japanese sailors have drowned as a result of these activities. To deny this is happening is absurd – no effort is being made to conceal this before the international community and in fact pictures of American submarines in Shanghai have appeared in newspapers in Italy and several South American countries. Furthermore, Japanese pearl divers have recovered artifacts from two American submarines which foundered while seeking refuge in this “International City” – the S-14 which sank just outside the harbor entrance, and the O-2 which is in the harbor itself. Japan will generously finance any effort by a non-combatant nation to salvage these sunken vessels.

“The British have nothing to fear from Japan, providing they stay in the Shanghai area, hex 52 39, as mandated by the League of Nations. Their comrades in Hong Kong and Siam can attest to this truth. Since their armed forces are in Shanghai, we expect them to follow the only honorable course of action and enforce mandate the League of Nations has entrusted to them, and rid Shanghai of those who illegally exploit its neutral status”.

The War Grinds On

Dateline, Shanghai, over cocktails at a British Consulate Dinner Party, a low-level British Diplomat was seen talking to a certain "Captain Mario", the royalist-leaning Italian Naval Attaché whom he knew from the Great War: . . . "Captain, off the record, off course, you must pass this along to your counterpart in Tokyo. The British position in Shanghai is a politically precarious one. Commonwealth Forces are here to safeguard ten's of Millions of pounds worth of business investment and maintain a strategic commercial trading position in the Far East, nothing more. We have no civil or legal authority other than what the local Chinese War Lord is willing to provided to us. Much of the city, including Chinese and American Military installations are off-limits to us, and what goes on there is beyond our control. It's very similar to the Boxer Rebellion situation, with Commonwealth Forces holed-up in dedicated positions around the city. Please note that it is the Nationalist Chinese Flag that oversees all here, and the Commonwealth's role is that of an outsider whose presence is merely tolerated. Efforts by Japan to blame, or hold accountable, Commonwealth forces for the actions of China or the USA miss the point entirely. Great Britain does not desire any type of confrontation with the Japanese Empire nor are we doing anything in Shanghai to aid or provide comfort for the other belligerents. Our Government would like the Empire of Japan to reconsider the last peace offer from the USA so that this bloody damn war can be ended as quickly as possible. However, should the Japanese attack Shanghai proper, Commonwealth Forces have been provided with sufficient latitude to defend themselves and key Commonwealth assets. Such a situation would also provided that terrible little man, Churchill, with the opportunity that he's been looking for to cast our lot with the Americans. That is something that very few us would like to see"

Captain Mario states “Well, fortunately our Il Duce is the very model of an enlightened leader, and would never involve Italy in an unjust war”. While his words sound sincere, the contortions on Captain Mario’s face indicates his meaning is closer to the opposite. “We are all servants of our government, of course. But in the meantime, I have some friends in high places in the Japanese civilian and military establishments. I’ll see what I can do. Let us meet here in 48 hours.

“Well”, says Captain Mario to the British diplomat, “this certainly has been an enlightening two days. Here is what I have found. The Japanese are becoming annoyed at the American submarine base at Shanghai. The Chinese attack north of the Yangtze River has provided them a convenient pretext to settle some old scores. My contact states the Imperial Navy is very concerned about provoking the Royal Navy, while the Army doesn’t seem to care. Apparently there is a vigorous disagreement between the services over what to do with Shanghai”.

Captain Mario paused for breath to let that sink in. “You must realize that I’m putting one of my contacts at risk with what I’m about to tell you. He is a patriot, just as we are, with access to some of the more reasonable members of the Imperial Navy. He seeks clarification of the British position regarding the American submarine base and Shanghai in general. His name is Captain Yuni, and will be waiting at this address on the Canton waterfront not far from the Hong Kong border at noon in two days. Please send someone you trust, with the information he needs”. Captain Mario then handed the British diplomat a sealed envelope.

“There is one more thing. Your statement two days ago about the best way for Great Britain to stay out of this war is to end it is correct. There are certain elements in the military, mostly the Navy, and the government that would like to see this happen as well. The official position of the Japanese government is that all American forces must withdraw east of Midway Island, return all former Japanese possessions, and quit claim on all former US territory west of Midway.

My contacts tell me there may be some room for negotiation here. Both sides have fought hard, but neither has decisively defeated the other. Japan has recently ceded some territory, but inflicted frightening losses on American forces while doing so. There may be an opportunity here. At this time, Japan may be more serious about negotiating with the Americans as equals, rather then treating them as a defeated power. However, they will not tolerate being treated as a defeated power themselves, or, what is the word in English? Oh yes – dishonorably. They will not tolerate being treated dishonorably. Honor seems to be very important in their culture, and may be part of the reason this crazy war started to begin with. Please convey this message to your American contacts”.

Japanese capture Wenchow

Crossing the Hong Kong - Canton Border in civilian clothes, Captain Jones met his Japanese Naval Intelligence handler, Captain Yuni, in a non-descript back alley tavern not far from the Catonese waterfront. Their relationship was one based on friendship, from the days that they had met as Junior Officers in training at Sandhurst during the "Golden Age" of British - Japanese relations. Both men were intense patriots who were deeply committed to their respective nations, and both also longed for a return to the period of Anglo-Nippon hegemony of the East Asia Region. In addition, Captain Jones was a committed American-phobe who resented the influence on British Foreign and Military behavior that Britain's indebtedness to America from the Great War entailed. "Neutral America continued to trade with the Bosch", he told Captain Yuni, "While our boys were dying on the fields of Flanders and The Somme. Now with Churchill leading the coalition government......... we're bound to get involved with something far more sinister than Gallipoli", he continued. It was not without a reason that Jones mentioned Churchill's Mediterranean folly, as this was the location where Jones lost his only command when his Pre-Dreadnought struck a mine trying to force the Dardanelles.

After several rounds of single malt Whisky and toasts to the health of each other's figurehead rulers, they got down to business. Jones handed Yuni an Admiralty document marked "Top Secret" concerning the Navy's rules of engagement in the event of hostilities in the waters off of Shanghai. This recent draft document was put together based on concerns for possible Imperial Navy responses to the illegal use of Shanghai for offensive operations by China and/or the USA. "Under no circumstances", the document said, "should Commonwealth vessels actively engage any attempt by the Japan to blockade the movement of Shanghai military forces of other belligerent nations in or out of the port of Shanghai". The document also when on to stipulate that Commonwealth Military vessels should only take what could be construed as passive defensive measures in order not to create an "incident" or an excuse for military escalation.

"You see, Yuni", said Jones, "these bloody fool American submarines come and go at night and are gone each morning. There's no question that they are using Shanghai in such a way that violates International Law. What I'm here to explain to you, is that the Admiralty is totally frustrated with the embarrassing situation that our cousins have gotten us involved in. Therefore, we feel the only way to level the playing field is for Japan to deploy a Naval blockade of Shanghai in order to contain the menace of these predatory vessels. While this action will also be criticized publicly by some, the use of an illegal blockade to strangle the Yank's illegal actions will be accepted by the Admiralty as a logical reaction that does not rise to a level of action sufficiently great enough to evoke a military response from The Commonwealth Nations."

Captain Yuni thanked his guest for his back channel help with this potentially delicate situation. "And now", he said to his British guest, "let's go the bathhouse and enjoy a wonderful evening together".

At a gala diplomatic reception in a Shanghai hotel, replete with formal suits, uniforms, and gowns, Captain Mario spots the British diplomat. After some small talk, he asks to step outside into the courtyard to share a smoke. “There is someone I would like you to meet”, he says. Walking across the courtyard, past several other couples whispering their own romantic or diplomatic intrigue, Captain Mario leads the diplomat through a door into a small room without any windows. A Japanese Naval Captain arises stiffly, and gives a deep bow.

“My name is Captain Yamamoto”, the Captain says in American accented English. “I have been instructed by my superiors to thank you for the information passed to Captain Yuni in Canton. I also inform you that our colleagues in the Army have seen the wisdom of the Navy’s position, and have pledged on their honor not to enter Shanghai unless provoked. British forces in Shanghai should be safe, providing they stay in the city…”.


Dateline, Washington, DC: Closed Congressional hearings were reportedly being conducted to investigate the Coolidge Administration’s Cabinet knowledge about media statements and allegations that the USA was breaking international agreements concerning military activities in the “Open City” of Shanghai. Amongst the numerous “No comment” statements outside the hearings by the Secretaries of State, War, and the Navy; there was a perceived tone of shock and cynicism from the witnesses as they passed through the corridors on their respective way in or out of the closed hearings. Also, for the first time since the debates leading up to America’s entry into the Great War, the areas outside the Capital Building were filled with throngs of anti-war activists and protestors.

Dateline: Washington DC. Before a closed door Senate Budgetary Hearing discussing
war-related expenditures and No-Bid Commercial Contracts for Non-USA Flagged Merchant vessels: "You see Senator," The Secretary of War replied, "we had absolutely no intention of circumventing the normal competitive bidding rules when contracting for the hauling military cargoes in the Pacific theatre when this conflict was thrust upon us. At the time, there was plenty of American-flagged commercial shipping available on both coasts to handle what was needed for the War with Japan.

Unfortunately, the heavy losses in shipping experienced in the 1st year of the conflict forced the War Department to seek-out additional shipping capacity that could not be replaced by new shipyard construction. The Administration was faced with 2 bleak choices, either we expropriate via Executive Order all merchant ships from any nation in US waters, or, we offered attractive enough lease rates to the carriers of non-belligerent nations to supplement the remaining American Merchant Marine capacity.

Based on these two unattractive options, the Administration made a decision to charter foreign-flagged vessels at rates that were deemed attractive enough to entice foreign entities to participate in the program. Hence today's request for supplemental funding to cover the unexpected costs".

"And what of America's liability for these shipping assets, should they be damaged or destroyed" the Senator from The Heartland asked.

"Because of the premium rates that are being incurred, each shipper has agreed to indemnify the USA in the event that these assets are damaged or sunk. Furthermore, all the crews have volunteered for this duty, albeit at more than three times the rate before the War with Japan", replied the Secretary of War.

"One more question, Mr Secretary. What is the flagged status of these assets when they sail with American cargoes?"

"All foreign ships signing-on under this program will be temporarily flagged with The Stars and Stripes. The US Navy will be responsible for safeguarding these ships, their contents, and their crews. This action will therefore minimize any potential
International consequences or repercussions that might occur in the event that these foreign-owned vessels are attacked by the Japanese”.
