You can always download the patch directly from the product page on the Matrix site. Most of my Matrix automatic updaters fail to patch games like in your screenshot, so I just download a zip from Matrix.

Check your anti-virus program's tech forums for info/help on allowing the Matrix Update.exe use a ftp to download files. I get the same error and it is my Kaspersky AV doing it.

Are you running your game as "administrator?" If not, try that.
