Oldest child, nearly 18, was leaving school yesterday in our 2004 Honda Element. She was pulling out of the exit and people were stopped to the left to pick up children at the curb, instead of waiting in the pickup line and someone pulled out and they collided. She is bumped and bruised from the airbag deployment, but it appears the vehicle is not going to be fixed by insurance (only the required liability on an older paid for vehicle). The damage, structurally, is minimal and the vehicle is drivable, but since the airbags deployed, the cost to fix may be more than the value of the vehicle and it would be hard to drive with the airbags everywhere...

Good morning all. Possibly a no fault insurance clause. A stupid clause instituted 30 years ago.

If the airbags deployed a citation should be issued. That is the law, at least here in Colorado. If a citation is issued, then fault is established.

In any event, the kid is OK. The rest is just details. I see my son driving around & my heart stops [X(] Every time. I can't wait for him to go to college, where he has to ride a bike because there is no place to park.

Don't think that is the law here in TN. But, since the vehicle was paid for, we only had liability insurance on it and are hoping the police report allows us to claim something from the other driver's insurance, as they were stopped illegally before hitting our vehicle.

While waiting on that, we are gathering more data on the following: What it would cost to just replace the airbags in the vehicle as the damage the vehicle itself was minimal, what a new used vehicle would cost to replace the other one in the 3-4k range as we have enough in savings and a small loan from our credit union and can get another vehicle pretty quickly that will serve our daughter for the next 4-6 years while she is in college, locally.

Anyways, keeping our options open, ready to go several different directions. Sound like a game we all play? [:D]
