It's also in the USA, but far more commonly found in commercial real estate applications. Instead of a 99 year lease (as used to be done on properties--Like the base at Guantamano Bay) , you will frequently see 20 year retail leases. "Buisness site, will build to suit ". Or "pad for lease". Very different from residential real estate.

Since when do 'leases' have mortgages for the lessee?

About 800 years , if I recall my English history correctly. And don't forget that American real estate law is based upon colonial real estate law, which was ...surprise! English real estate law. And there are all kinds of other weird real estate entaglements like lif estates (where you live on the property fot the rest of your life , but can't sell it, etc.....all kinds of weird stuff still on the books, but rarely used. ). Thank God. Usually only reseserected for Real estate Broker licence exams and by real estate lawyers with a strange thing for....well strange things, [:D]

About 800 years , if I recall my English history correctly. And don't forget that American real estate law is based upon colonial real estate law, which was ...surprise! English real estate law. And there are all kinds of other weird real estate entaglements like lif estates (where you live on the property fot the rest of your life , but can't sell it, etc.....all kinds of weird stuff still on the books, but rarely used. ). Interesting....Wiki has a good bit of info on leasehold property (and tenancy accordingly). It mentions nothing about mortgages though. Tenancy according the Wiki usually involved considertion (i.e. rent), though it does mention that the tenancy can be bought and sold.

So do you pay both rent and your mortgage payment if you buy something like this? [X(]

Well, the ex decided to get gnarly about the division of assets thing, so have to sell the house in Cali. But maybe 12 years ago we bought a spot on the South shore of Hi'va O'a in the Marquesas, that the lawyers say is mine, all mine.

Gonna have to remember all my French, and learn a lot more, besides. Will need a sat-phone uplink to commo with the world, too. Yeah, not bad .. can dig it .. I mean, people who know their Rhones and can do veal .. and who know what sailing is.

I ain't going anywhere that doesn't have four seasons...at least not permanently. And definitely not some tropical island where I can procure malaria, dengue fever and cyclone poisoning.....[:D]

Like everything that lawyers create or keep their hands in, "That depends". Or as a lawyer would say , "That's case specific". I've seen commercial leases that might charge you rent and a percentage of your monthly profit (as in a retail store in a mall). Usually if you have a mortgage , it's because you put up a building. And again as an example take a retail store, say a discount store. Did you ever notice how a K-mart or "K-Mart type building goes completely to hell after 20 years? And they generally rebuild it or move and build another close by? That's because the buiding is only built to survive 20 years. Because that's how long the building site lease is for. Mall are built for a slightly longer term and down-town department stores are built forever--no lease. You generally will have a mortgage for the life expectancy of your building , which is the "life-expectancy of your lease". I'd love to know who thought up this crazy system. It's almost as insane as the aircraft "sell and lease back" scheme. I suppose it works , but it sounds strange. [&:]
