shattering Vs surrender

I am currently playing a 41 campaign as russian and have on several occassion noticed something which I find peculiar.

My opponent and I are having some serious fighting down south, and I have on some occassions managed to surround a few of his corpses.
What I have noticed is that if I surround more than one corps, and then force one of these to retreat. It will first try to retreat back over the over corps, but will then shatter when it has nowhere to run.
Shouldnt it surrender, since basicly it is being surrounded ?

Maybe it should, and maybe not. Technically, at the time of attack it is surrounded, but the game engine has a tough time figuring this out according to Arnaud, the programmer. Also, forces did frequently get away, without their equipment, and suffering heavy losses, which a shatter does result in. Finally, if the attacker has just closed the pocket, because the game is in turns without any reaction phase, who is to say that some of the units were not able to get out in front of the pocket closing. In any case, it used to be that a shatter, at least in the first turn of the campaign, only resulted in about 35% of the tanks being lost for example, and now it is more like 65%, so it is better.
