Can you promote a 3 to 4 star? Or are 4 stars determined at the beginning of the scenario? Napoleon should be a 3 star in 1796 but after 1799 become a 4 star....

Yes a 3-star can promote through Fame to a 4-star. But remember that the players.txt file has to have a value of at least "1" in the 4-star column for promotions, for a Nation, to make it possible.

If memory serves, only 2 Nations - Russia and France - have a "1" in the 4-star column; all other Nations have a "0" (meaning no new 4-stars).
