Depleted units not retreating?

I'm assuming the Soviet unit in the red box is depleted. I assume this because if I advance another unit it automatically displaces. But the unit already next to it doesn't trigger that response. Attacking it causes it to defend with 0 combat and it does displace.

Should it be able to start a turn there?

Is this just after the supply phase? Do you have a save prior the supply phase?

I have the save from the start Sov_AI turn prior. I'm assuming this is what you mean. It's attached, although I haven't had a chance to re-run it to see if it repeats.
