Polish units not counted?

First I realize I don't have save files for this but in a Global War with my friend we have encountered two issues with the Polish naval units.

On one occasion the polish cruiser could move without using the CW limit for naval moves. CW moved 2 CW naval units as well as the Polish cruiser.

In S/O-39, Allies #6. The Polish cruiser moves from Danzig to box 2 in the north sea where the non-intercepting german naval air is located in Axis sea box 3. Other units are FTR and 2 x CW cruisers in allied sea box 1 and another FTR in allied box 2 (together with the Polish cruiser).
Allies start searching and the rolls are Axis 1, Allies 8. The Axis selects only box 2, spends 6 Surprise Points to lower CW FTR and 4 to raise German NAV. The combat ensues and the NAV clears through. The phase continues but there is now a message saying there are no naval units for the german NAV to attack.

I might be wrong but it seems to be some kind of issue with recognition of polish naval unit here.

Was the Polish naval unit aborted? If so, then it is no longer available as a target.
