TOE/Device Upgrade Question

I'm trying to understand device upgrades with regards to TOE usage and I'm being told something I don't exactly believe and would like to get clarification from here. For the following US infantry division TOEs"

2511-USA Infantry Div thru 420701 and uses 1101-USA Rifle Squad good thru 4207

2512-USA 1942 Infantry Div thru 450701 and uses 1102-USA Rifle Squad 42 good thru 4301

2513-USA 1945 Infantry Div thu end of game and uses 1104-USA Rifle Squad 44

Now for the 2512-USA 142 Infantry Div the rifle squads should upgrade (within the 2512 unit TOE
1103-USA Rifle Squad 43 on 4301
1104-USA Rifle Squad 44 on 4312

I'm being told that the squads will NOT upgrade in the 2512 units but ONLY when the unit TOE
changes which would be in 450701.

I was always under the impression squads/devices upgrade when they become available.

Who is right?

Another good example is the 2357-USA Infantry Rgt which upgrades to the 2387-USA 42 Infantry Rgt on 420801. The 2387-USA 42 Infantry Rgt uses 1102-USA Rifle Squad 42.

There is no further TOE upgrade so either the 1102-USA Rifle Squad 42 upgrades to 1103 which upgrades to 1104 or the regiments using that TOE use the 1102-USA Rifle Squad 42 until the end of the game.

Like I said above I was under the impression and still believe the squads will upgrade but want confirmation.

TOE must upgrade to get the new devices "authorized'. Only then can it actually swap out the old squads for the newly approved one. And just because it can use the new device, does not make it certain that it will.
Things like base size, supply levels, HQs and the number of new squads in the pools play a part in the die roll to upgrade the device.

IIRC, an LCU must be in Rest/Training mode to upgrade the TOE (but that's just a list - the actual devices come when all the other conditions are right).
