Capitals occupation in PBEM games - forced surrender?

As much as I understood from the forum, having your capital occupied
from unbesieged enemy factors forces you to conditional surrender.
This is of course deeply different from EIA rules.
A few questions, if someone can kindly give us an answer:

1) Is this true in PBEM games too?

2) Does it happens during the economic phase only (when one would lose revenue)
or at every diplomatic phase?

3) Are you addressing the bug in future patches?

4) Is the forced surrender only conditional? i.e. what happens if the occupying
power accepts only unconditional surrenders?
