Axis Spain bug?

Just got around to learn the game and may have found a bug (ver.1.08). It is the end of August 18, 1940 and am playing as Axis. I am given a chance to create Vichy France and I say yes. Vichy is created and Spain prepares for war and becomes an active minor. DE 603 conditions were not in effect. No MPPs were spent, there are no German units within three hexes of Algiers. Spain was at 53% Axis. Is Spain becoming Axis a random event?

Just before this Paris was captured, and Germany controls 1-2 hex around it. Br lost an aircraft carrier near Norway. Fr armor destroyed along with the Alps army. The Italians are deep into Tunis and in full control of Libya(this turn).

Have the Axis been investing in diplomacy that may have influenced Spain?

A second question is whether the Allies have left Gibraltar empty at any point, as this will also swing Franco towards the Axis?

Yes I had 2 chits to Spain. I read it was very hard and certain conditions needed to occur. I guess diplomacy over rides some of that.
