Vichy option didn't appear?

We are in a game doing EOT where Germany just took paris in JA 40 but a vichy option never appeared for either side. Does German player have to actively do something? French player got a "surrender france" option but shouldn't germany get option to create vichy?

I looked at autosave folder and the last vichy creation check autosave was oct 23, but we just went through eot tonight with vichy possible for germany.

EDIT: We figured it out. In case this helps anyone else, GE took Paris then left the hex. You need to have a unit in Paris to declare Vichy.
