Refit in Combat

Does it matter if a unit is in refit and either attacks or defends?

Can a unit in refit be next to an enemy unit and still get replacements?

Yes, you can get replenishment in contact with the enemy, it will be lower than if replenishment occurs in the rear in a warehouse, especially if in a national reserve.

You can easily test this in a quick scenario against the AI.
