'Free' French Units Naval Unit Question

From the Strategy Guide:
Free Units “ ”Units of a number of countries have a chance of fighting on from exile and becoming free units if their country surrenders The chance of a unit not surrendering is as follows and note that land and air units will have to be outside their home territory if they are to do so.

FRANCE
-France if Vichy is formed> Land Units 20% each / Naval Units 0% each

-France if Vichy is not formed > Land Units 40% each / Naval Units 40% each

For the latter (if Vichy is not formed), do the French naval units get the percentage roll to be free while at sea or do they have to be in an Allied port?.

Haven't really paid attention.
I don't think the Free French ships fly different flag.
Why? Don't think I've every gotten any or they look British.

I have gotten the French Engineer unit, few times, when it's been sent to Egypt.
Digs fortresses for remainder of game, just remember you must start in Supply-5 or greater to do so.

Occasionally I've sent French units (Air mostly to England), which remain after surrender.
Those Air units so weak, doesn't really matter.
Same with ground, guess you could call them garrisons.
Slaps issued: 16 - Patton, Dana White, Batman, Samson. Medals/Salutes given: 6, warnings received: 11, suspensions served: 4, riots: 2.

I always send that French engineer to Egypt too to get digging near El 'Alamein. If I'm lucky, I'll get two 2 sided fortifications in before they surrender. If real lucky I get to keep it with the beneficence of the Random Number Goddess 💃✨✨✨🎲
